SNOKIE TRUCK REPAIR,
Petitioner,
v.
)
PCB 73—310
ENVIRONMENTAL PROTECTION AGENCY,
Respondent.
OPINION AND ORDER OF
TIlE BOARD
(by Mr. Henss)
On July
31,
1973 Skokie Truck Repair filed a petition for
variance to allow connection of
a new sanitary sewer to an
existing sewer line.
Petitioner alleged that a septic system
servicing its business was no longer operable and that the con~
nection was necessary if the business was to continue to operate.
The petition was inadequate in that it failed to state the
number of employees at the business site,
the estimated quantity
of
sewage
to
be
discharged
through
the
proposed
connection
and
the
name of the sewage treatment plant to which the sewage would
flow,
On August 9,
1973 this Board ordered Petitioner
to supply
this additional information within
35 days.
Petitioner has failed to provide the additional information
and,
in fact,
has not responded to our Order in any manner.
Since the petition is inadequate and there has been a failure
to
comply with the Board Order or to otherwise prosecute the case,
we are compelled to dismiss the petition without prejudice.
The petition for variance is hereby dismissed without prejudice.
