    OPINION AND ORDER OF THE BOARD

    Petition for variance from Rule
    203(f)
    of the Water Pollution
    Regulations
    to exceed the water quality standard of 0.02 mg/l for
    copper by using
    copper sulfate for algae control was filed August
    8,
    1973.
    The Environmental Protection Agency filed its recommendation
    on September 10.
    It recommends
    a grant of the variance subject
    to
    conditions listed in the order below.
    In previous opinions of the Board
    (City of Mount Olive, et

    PCB 73-124, August

    EPA, PCB 73-312,
    September

    1973)
    we have granted variances this year for control
    with copper sulfate in order to prevent taste and odors in the water
    supply.
    We have pointed out,
    however, that alternatives consisting
    of other algicides exist
    as well
    as the possibility of selected
    stocking with algae-eating fish.
    The Agency recommendation describes
    the “final report” by
    Dr. Charles Muchmore of Southern Illinois
    University.
    We have had the interim report submitted to us on
    May 30,
    1973 but to date have
    not received the final report.
    We
    grant the variance but ask that
    the Agency and Institute for
    Envirc~r~entalQuality furnish the final report as soon
    as possible
    in ord~rthat we may complete our evaluation
    of the alternative
    solutions
    to the algae problem
    as future cases
    come up for decision.
    ORDER
    1.
    Variance is granted to exceed the 0.02 rng/l water quality
    standard for copper in Rule 203(f)
    in order to apply copper
    sulfate to the Ashland water supply reservoir for the period
    of August through October,
    1973 inclusive.
    2.
    Treatments
    shall not exceed one per month for the period
    stated.
    Not more than 100 lbs.
    of copper sulfate shall
    be used per treatment.

    3.
    The copper concentration in the raw water intake shall
    never exceed 1.0 mg/l.
    4.
    Copper concentration in the water supply reservoir shall
    be measuTed before and after each treatment and reported
    to the Agency on a monthly basis.
