ORDER OF THE BOARD (by T.E. Johnson):

On December 19, 2002, the Board, at the parties’ request, extended until February 26,
2003, the time period within which Carter Convenience Store (Carter) may appeal an
October 24, 2003 determination of the Illinois Environmental Protection Agency (Agency).
    See

    415 ILCS 5/40 (a)(1) (2002); 35 Ill. Adm. Code 105.406. The Agency denied part of Carter’s
request for reimbursement from the Underground Storage Tank Fund regarding a leaking
underground storage tank site on Route 45 in Mills Shoals, White County. Because petitioner
failed to timely file an appeal, the Board dismisses this case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on March 6, 2003, by a vote of 6-0.

    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
