    Petition filed December 19, 1973 is inadequate in that
    no violation is shown. No discharges in excess
    of
    the applicable
    Regulation is alleged. Furthermore, the petition states ~‘weare
    well below the limits of contaminants discharged”. A violation of
    the Regulation either existing or prospective is a condition
    precedent to a variance. The case is dismissed without prejudice.
    IT IS SO ORDERED.
