OPINION AND ORDER OF THE BOARD (by Mr. Dumelle)
The petitioner filed a variance request on May 14, 1973 to
extend a variance granted March 22, 1973 (PCB 73-23) from April 30,
1973 to July 30, 1973. No hearing was held.
Pet:itioner states that the only unfulfilled condition of prior
variances has been the Board condition that a stack test be performed
before April 30, 1973. It alleges that the testing company needs
more time to do the tests and necessary laboratory work. It promises
not to operate the 500 ton/day incinerator without using the new
scrubber.
The Agency’s recommendation filed June 22, 1973 recommends a
grant. It states that two tests were done on April 25 and six tests
were run on May 30-31, but that a further test is needed.
We grant the variance until July 30, 1973 subject to the condi-
tions in the Order.
ORDER
1. All applicable conditions of previously granted Variance will
remain in full force and effect;
2. All bonds posted by Petitioner to comply with the Pollution
Control Board’s Order of March 22, 1973, shall remain in full
force and effect;
3.
Petitioner shall not
operate its incinerator without having the
scrubber
in operation;
4. Petitioner shall perform a stack test as soon as possible.
Petitioner shall notify the Agency’s Surveillance Section,
Division of Air Pollution Control, Illinois Naval Armory,

East Randolph at the Lake, Chicago, Illinois, five (5) days
in advance of the scheduled stack test so Agency personnel can
observe the test if they desire. Stack test results shall
be submitted to the Agency in writing thirty (30) days from
the day of the last test and in no event later than July 30,
1973.
