DISSENTING OPINION (by J. Theodore Meyer):
I dissent from the majority opinion because, although the Board regularly accepts
stipulation and settlement agreements in enforcement cases, wherein the respondent neither
admits nor denies the alleged violations but agrees to pay a penalty, the Board does not
recognize such settlement agreements in administrative citations. I believe that the Board
should be consistent in its approach to settlements and accept or reject them in both types of
cases.
