ORDER OF THE BOARD (by Mr. Seaman):
On February 28,
1974,
this Board granted Petitioner
a variance
from the provisions
of Rule 205(f)
of the Air Pollution Control Regu-
lations until
April
1,
1974.
By the instant Motion To Amend Order,
filed March
18, 1974, Petitioner seeks extension of said variance
until
May
1,
1974.
Petitioner alleges that one-month extension
~S
necessary because
its supplier made an error in the design
of
the control
panel
for an
incinerator,
the operation of which
is
part of Petitioner’s control
plan.
Due to
this error, delivery of the control
panel
will
be
delayed until mid-April.
Petitioner states that virtually all other materials and equipment
necessary for the completion of
its control program has been received
and all necessary construction and installation work that can be
completed without the control
panel
has
been or will
be completed prior
to April
1,
1974.
Petitioner’s allegations are supported by
the
sworn affidavit of David
A.
Leligdon, Assistant Chief Engineer for
Respondent.
We note that the Agency’s Recommendation regarding Petitioner’s
initial
request for variance indicated that Petitioner unknowingly
may have requested too little
time.
We hereby grant the extension of variance, until
May
1
,
1974, from
the provisions of Rule 205(f)
of the Air Pollution Control
Regulations,
retaining the condition
in our initial Order that,
upon completion
of
the control
system,
Petitioner shall
notify:
