1973 Ozite Corporation filed Special and

Limited Appearance and Motion to Strike and also filed a Motion

to Dismiss Counts

2 and 3 of the Amended Complaint.

These

Motions seem to be a repetition of Motions made by the Respondent

earlier.

The Special and Limited Appearance and Notion to Strike is

denied for reasons expressed in our Order of September

13,

1973.

Since hearing has already been held in this matter the

Motion to Dismiss Counts

2 and 3 will be taken with the case.
