Petitioner Continental Can Company, Inc. has filed Motion

for Order Compelling EPA Recommendation. The EPA Recommendation

has now been filed and therefore, the matter is now moot. If

Petitioner contends after reviewing the Recommendation that

the lateness of filing has prejudiced Petitioner~s case then

Petitioner should bring that matter specifically to the attention

of the Board or the Hearing Officer in a request for new hearing

date.

Motion for Order Compelling EPA Recommendation is denied

as moot.
