The Environmental Protection Agency has filed Objection

to Petition for Variance along with Motion for Hearing.

The

Objection was not filed within 21 days after the variance

petition was filed and therefore hearing is not mandatory

but is within the discretion

of the Board.

The Agency has

not given us any facts in support of its Motion for Hearing

nor has the Agency filed its Recommendation.

We will not

rule on the Motion for Hearing until the Agency has filed its

Racommendation.
