ORDER OF THE BOARD (by Mr. Oumelle):
The Pollution Control Board hereby dismisses the above-captioned
complaint without prejudice.
Complainant has included allegations over which the Board has
no jurisdiction or which seek premature review of a permit currently
on file with the Agency. In fairness to the named Respondents, the
Board has dismissed the complaint rather than having the extraneous
material stricken.
A partial listing of material facts, allegations, and prayers
over which the Board has no jurisdiction are as follows:
Count I, Paragraphs 8, 9, 10 and 13 as applied to
future activities
Count II, Paragraphs 8 and 11(d)
Count VI as it applies to flooding rather than pollution.
This listing is not meant to be complete, nor does it indicate Board
acceptance of other individual counts on Paragraphs and as such does
not prejudice any party.
In the event Complainant files a new tomplaint, Complainant
should examine Board Procedural Rules 304 and 305. A complaint should
clearly state what provisions of the Act or Board Regulation is alleged
to have been violated. The complaint should also include a short,
concise statement of the facts sufficient to apprise the Respondent of
the nature of the alleged violations.
