    OPINION AND ORDER OF THE BOARD (by Mr. Dumelle):
    An extension of the variance previously granted by the Board
    from Rule 2-2.53 of the older air pollution regulations was filed on
    November 5, 1973. In PCB 72-441 the Board granted a variance to
    January 30, 1974 subject to extension to July 31, 1974 which was
    the estimated completion date of the control program. No public
    hearing was held.
    The Environmental Protection Agency filed its recommendation
    on November 26, 1973. It recommends a grant and states that
    “petitioner has been diligent and should be granted the extension’t.
    The 22 ~‘IWelectric power generating station near Pearl in Pike
    County will have a ~600,000 scrubber installed to control particu-
    late and sulfur dioxide emissions. The Agency has received no
    comment from the public concerning the present variance proceeding.
    The verified petition states that contracts were awarded on
    May 2, 1973; that one phase of the compliance activity is 30
    days behind schedule; and that the July 31, 1974 date can still be
    met if no further delays are encountered. The consulting engineering
    firm, in its affidavit, put the lag at “four to six weeks behind
    schedule” but also approves the July 31, 1974 date as a valid one.
    We grant the variance to that date since all conditions of
    the original variance (PCB 72-441) appear to have been met.
    This opinion constitutes the Board’s findings of facts and.
    conclusions of law.
    ORDER
    Variance granted from Rule 2-2.53 in PCB 72-441 is extended
    until July 31, 1974 subject to all applicable conditions of that

    proceeding, namely, quarterly reporting, blending of fuels, and a
    $250,000 performance bond.
    IT IS SO ORDERED.
