    OPINION AND ORDER OF THE BOARD (by Mr. Seaman)
    The Petition for Variance was filed with the Agency
    on November 1, 1973.
    Petitioner operates an industrial manufacturing
    facility located in East Moline, Rock Island County,
    Illinois. At this facility, Petitioner has four (4)
    boilers for production of process steam and heating.
    All four boilers can burn either natural gas or No. 5
    oil. Boiler No. 1 is a chain grate stoker and is used
    during the winter with coal as its main fuel. Only one
    boiler is used at a time except in very cool weather when
    a second boiler picks up the load.
    Petitioner is installing a fabric filter on Boiler
    No. 1 to control particulate emissions. Petitioner planned
    on having the fabric filter installed by November, 1973.
    Petitioner states that because of the failure ~of equipment
    delivery, the final completion date will be delayedto
    no later than March 31, 1974. Therefore, Petitioner is
    requesting a Variance to operate this boiler in excess of
    applicable regulations until the fabric filter system is
    installed and operational.
    Emissions from a coal—fired boiler of this type
    calculated by the Agency using Compilation of Air Pollutant
    Emission Factors, AP-42, Table 1.1.2, are:

    exceed the standard set forth in the Rules and Regulations
    Governing the Control of Air Pollution and Rule 203(g)
    of Chapter 2, Part II of the Regulations of the Pollution
    Control Board. Assuming correct operation and maintenance
    of the baghouse, Petitioner should achieve particulate
    complaince with its control program.
    Petitioner entered a binding agreement for the fabric
    filter on May 15, 1973. The United States Environmental
    Protection Agency estimates that a fabric filter system can
    be completed within 53 weeks. Even with the extended
    completion date, Petitioner will achieve compliance within
    the recommended schedule presented by the U.S. Environmental
    Protection Agency.
    The Agency has received no comments from the public
    concerning this Variance. The plant is located in an
    industrial area where few residences exist.
    This Opinion constitutes the findings of fact and
    conclusions of law of the Board.
    ORDER
    IT IS THE ORDER of the Pollution Control Board that:
    1. A Variance be granted to March 31, 1974 or
    until the baghouse is operational, whichever
    is sooner, subject tO the following conditions:
    (a) Petitioner shall utilize Boiler No. 1 on
    coal only when other sources of steam are unavailable
    or when gas and/or oil are unavailable for use in
    Boiler No. 1.
    (b) Petitioner shall notify:
    Illinois Environmental Protection Agency
    Division of Air Pollution Control
    Control Program Coordinator
    2200 Churchill Road
    Springfield, Illinois 62706
    upon completion of the baghouse program.
    (c) Petitioner shall attempt to obtain alternative
    fabric filters for use in the baghouse in the event
    delays beyond January 31, 1974 are encountered in
    obtaining the Kynol bag.
