ORDER OF THE BOARD (by Mr.
Seaman):
On June
17,
1974, Clark Oil
and Refining Corporation filed
its Petition For Nondisclosure.
Petitioner moves therein for
acceptance of certain information
as privileged against disclosure
to the public and states as
follows:
1.

John Nuss
has submitted
as Clark Exhibit
2 an affidavit
supported by certain Tables, Letter,
and attachments from UOP (Universal
Oil Products).
2.
The affidavit is based on, among other documents,
a certain
letter attached thereto from J.
G. Wenner of UOP to
Mr. Keith Forry
of Clark and dated March
30,
1972.
Said letter has attached thereto
documents entitled Attachment
I dated 1/27/72 and
a document entitled
FCC YIELD ESTIMATE NO.
2005A,
DATED 2/16/72.

Petitioner moves
that the above referenced letter and docu-
ments
are privileged for nondisclosure provtsions
of the Board under
PCB
Regulations Rule l07(b)(4) which
applies
to “information con-
cerning secret manufacturing processes or confidential data submitted
by
any person under the Act.
4.
Petitioner states that such letter and documents as herein
referenced were developed for Clark by
UOP under
a secrecy agreement
coveriflg UOP design and operating licenses applicable
to Clark’s fluid
catalytic cracking units.
Information contatned therein would advise
certain non—licensees
of UOP
and certain competitors of Clark of new
operating characteristics and processes not
in general
use by refiners
and,
further, protected by certain nonperfected patent rights possessed
by UOP.
