OPINION
AND
ORDER OF THE BOARD (by Mr.
Seaman):
On
February
14, 1974,
International Paper Company filed
its Petition
for Variance, seeking therein variance from the provisions
of Rule 205(f)
of the Air Pollution Control
Regulations until
May 31,
1975.
On March
27,
1974, Petitioner filed an Amended Petition.
Petitioner owns and operates
its
Folding Carton and Label
Division in
Peoria, County of Peoria,
Illinois.
At the Peoria facility, Petitioner
manufactures printed ‘labels for food containers.
The labels are designed,
printed,
varnished,
cut to size, and packaged according to customers
requirements.
The Petition for Variance is concered with the varnishing
operation.
AT least 75,000 gallons of varnish and 65,000 gallons of
thinner are used per year.
The plant employs 350 people.
Petitioner had operating permits when it filed the Petition for Variance.
The permits expired
on March
31,
‘1974.
The permits included
a Compliance
Plan which called for the use of exempt solvents to meet Rule 205(f).
However,
in January 1974, Petitioner was informed by potential suppliers
that
it would not receive the exempt solvents.
Petitioner does not currently
have operating permits from the Agency because it cannot demonstrate
compliance with Rule 205(f).
Petitioner states that emissions from its varnishing facility are
approximately 19.5 pounds per hour from each of its three varnishing
machines.
Varnish
is applied
to approximately one-half of the labels made
at the facility to produce
a glossy finish and to make the labels water-~
and scuff-resistant.
Petitioner formerly discharged an additional
3.8 pounds per hour of
photochemically reactive material.
However,
Petitioner switched to
a new
thinner on January
1,
1974, and reduced the amount of photochemically
reactive material emitted.

Petitioner plans
to achieve compliance by utilizing non-photochemically
reactive varnish
as
it becomes available.
In addition, Petitioner
is
currently conducting research with waterbase varnishes, although it has
been unsuccessful
so far.
Petitioner states that it will submit detailed
specifications for waterbase varnish requirements
to suppliers by
June
1,
1974 and will request responses on or before December
1,
1974.
Petitioner will then evaluate the varnishes by laboratory tests and by
tests on its machines.
If Petitioner determines that one of these varnishes
is acceptable from the standpoint of both cost and suitability for
Petitioner’s
requirements,
it will begin ordering the new varnish no
later than March 31,
1976.
Petitioner will purchase and replace
its
inventory no later than April
1,
1975 and will begin using it no later
than May 1,
1975.
Petitioner is also investigating the use of active carbon filtration
in addition to searching for new sources
of exempt solvent and waterbase
varnish.
Petitioner’s plant
is located
in an industrial
park
in Peoria,
There
are no citizen complaints.
This Opinion constitutes the findings of fact and conclusions of law
of the Board.
IT
IS THE
ORDER of the Pollution Control Board that Petitioner be
granted a variance from the provisions
of Rule 205(f)
of the Air Pollution
Control
Regulations
until May31,
1975, subject
to the following conditions:
a.
Petitioner shall
utilize as much exempt solvent
formulations
as
can be furnished by its suppliers.
b.
Petitioner shall notify the Agency imediately
if
any deviation from the compliance time table occurs.
c.
Petitioner
shall submit quarterly reports
to:
Environmental
Protection Agency
Division of Air Pollution Control
Control
Program Coordinator

Said reports shall detail:
‘1.
total
amount of solvents used during the quarter;
2.
nature and amount
of non-exempt solvents used;
3.
nature and amount of exempt solvents used;
4.
nature and amount of exempt solvents purchased
(indicating the supplier);
5.
nature and amount of non-exempt solvents purchased
(indicating the supplier);
6.
nature and amount of solvents in inventory at the
beginning of each quarter.

d.
Within
6 months
of the date of this Order, Petitioner
shall submit to the Agency
a modified compliance plan.
This plan
may:
i.
Achieve compliance at the expiration of the Variance
by replacement of photochemically reactive solvents with non-reactive
solvents demonstrated to
be readily available;
or
ii.
Achieve compliance at the expiration of the Variance
by qualification under the Alternative Standard of Rule 205 (f)(i);
or
iii.
Achieve compliance by
May 30, 1975 under the provisions
of Rule 2O5(f)(2)(D).
