ORDER OF THE BOARD (by Mr. Henss):
On March 14, 1974 National By-Products, Inc. was granted
a variance from Section 9(a) of the Environmental Protection
Act and Rule 802(b) of the Air Pollution Control Regulations
for its Decatur rendering plant until August 15, 1974 for
the purpose of constructing a cover over its hotwell and
evaluating the odor reduction effects of such cover. The
variance was made subject to certain conditions including
in Paragraph 2 the following:
~The installation of the hotwell cover and sub-
sequent routing of all.noncomhustible gasses from
the hotwell to the plant boiler shall be completed
not later than June 1, 1974”.
The Company now reports that because of unusually heavy
rain the plant was flooded for the first time in thirty years
and it is estimated that it
will
be thirty days before the
plant can be put back into operation. The Company requests a
thirty day extension for completion of Item 2 of the Board Order
so that the hotwell cover program will he completed by July 1,
1974
rather than the original June 1, 1974.
This matter
was
originally docketed as a new variance
petition but upon reconsideration the Board chooses to consider
it a motion ~uhsequent to entry of final order, The reason for
this is
that
the motion could be allowed without extending the
variance which was originally granted to August 15, 1974. The
Board specifically extends the time within which any party may
file a motion for rehearing or modification of the Order to and

including the date when Petitioner’s reauest was filed.
Agency response shall he filed within 10 days of the date
of this Order.
