On May 29,

1974, Respondent filed a Motion For Non-Disclosure

regarding its financial statement for the Marseilles facility for

1972 and 1973, We agree with Respondent that exclusion is warranted

at the present time under our Procedural Rule 107(b) (5).

We grant Respondent~s Motion but make such grant expressly

subject to paragraph 6

of

the Motion, which states:

“6. That

the

Respondent stipulates that if this cause

should proceed to hearing and that if the information

contained in the attached document (financial statement

for

1972

and 1973) were to become an

issue

in said

hearing, the said information would be disclosed at

the hearing to the extent necessary.”
