R03-20
(Rulemaking)
ORDER OF THE BOARD (by T.E. Johnson):
On February 18, 2003, the Environmental Protection Agency (Agency) filed a motion for
acceptance of a newly-proposed rulemaking. The Agency proposes amendments to the Board’s
existing site remediation program (SRP) regulations at 35 Ill. Adm. Code 740 and addition of a
new Subpart H. The new Subpart H would establish procedures for requesting Agency review
and payment of remediation costs under the newly-amended Brownfields Site Restoration
Program (5 ILCS 415/58.15 (2002)).
More specifically, the Agency seeks to amend Sections 740.100 (Purpose) and 740.120
(Definitions) of the existing SRP rules. In addition, the Agency proposes adding a Subpart H,
which would include Sections 740.800, 801, 805, 810, 811, 815, 820, 825, and 830.
The Agency states that the recent legislative amendments are very detailed, and that most
of the proposed changes mirror the statute. Statement of Reasons, p. 8. The petition meets the
content requirements of Section 102.202 of the Board’s procedural rules.
See
35 Ill. Adm. Code
102.202. The Board accepts the proposal for hearing and directs the hearing officer assigned to
this matter to expeditiously schedule hearings as required by Title VII of the Environmental
Protection Act. 415 ILCS 5/26
et seq
. (2002).
IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on February 20, 2003, by a vote of 7-0.
