    OPINION
    AND
    ORDER OF THE BOARD (by Mr. Seaman):
    This
    is
    a
    Petition to Partially Extend
    a Variance which was
    filed with the Agency
    on March 29,
    1974.
    The Petitioner
    is the Celotex Corporation which operates
    a
    roofing mill
    in Wilmington that includes
    an asphalt saturator
    and other related equipment.
    On June 21,
    1973,
    the Pollution
    Control Board granted Petitioner
    a variance until
    March
    21,
    1974 from Rule 2-3.111
    of the Rules and
    Regulations Governing the Control
    of Air Pollution and
    Rule 203(a)
    of the Air Pollution Control
    Regulations.
    Said variance was to allow
    Petitioner time to install necessary pollution control equipment with
    respect to its asphalt saturator, filler dryer,
    and heater facilities
    (PCB
    73—123).
    Petitioner
    is now seeking
    an extension of the original variance
    until
    June 20,
    1974 only with respect to the asphalt saturator.
    The Environmental Protection Agency investigation has revealed
    that the heater facilities and filler dryer are now controlled.
    The
    HEAF (High Filter Air Filtration) unit for controlling particulate
    emissions from the asphalt saturator
    is currently being installed.
    The start-up of the HEAF unit is expected on or before April
    25,
    1974 to
    be followed by eight weeks of testing.

    Petitioner alleges that the delays
    in delivery were totally
    the fault of the equipment supplier.
    The Agency has received no citizen complaints regarding the
    partial
    extension
    of the variance.
    The Agency feels that denial of Petitioner’s variance would
    constitute undue hardship.
    This Opinion constitutes the findings of fact and conclusions
    of law of the Board.
    IT IS THE ORDER of the Pollution
    Control Board:
    1.
    That Petitioner’s orignial variance (PCB 73—123)
    be extended
    to June 20, 1974 as
    to
    the asphalt saturator only, subject to the
    fol lowi rig conditions:
    a.
    Within ten days of the date the HEAF unit
    becomes fully operational, Petitioner shall
    notify the Agency.
    Said notification shall
    include
    a
    report
    of
    the
    status of operation
    of
    the new equipment and a summary of stack
    test
    results.
