ORDER OF THE BOARD (by Mr. Marder)
Petition for variance is inadequate for the following reasons:
1) There is no explanation as to why control equipment
was not ordered until February 18, 1974. Rule 206
went into effect for existing sources on December 31,
1973. Data as to the delay in beginning a compliance
program is required.
2) There is very little information as to the environmental
impact of granting the variance. Rule 401 (c) of the
Board’s Procedural Rules refers to “The injury that the
grant of variance would impose oi~the public including
the effect that continued discharge of contaminants
will have upon the air, water, and land” (emphasis add-
ed). There is no data as to the locatlon of residences
or community buildings in relation to Petitioner’s re-
finery.
Petitioner shall file an amended Petition in this matter within
30 days of receipt of this Order, detailing the above requested in-
formation, or suffer a dismissal.
