Motion to Dismiss filed by the Agency on July 9, 1974
is granted. Both the existing regulation, (Rule 3-3.112) and
the regulation effective May 30, 1975 Rule 203(g) (3)1 allow
0.6 lbs. of particulate matter per million BTtJ of heat input.
Petitioner states (Exhibit C) that only 0.54 lbs. per million
BTU are presently emitted.
There is no showing of a violation of a rule or regulation
and the ~etitioñ is defective.
Petition is dismissed without prejudice as inadequate to
establish grounds for which a variance could be issued.
IT IS SO ORDERED.
