    The Environmental Protection Agency filed
    on
    July 9, 1974, a
    motion bo dismiss the above titled action.
    The action was originally
    filed on Septether 27, 1973, charging certain violations of the
    Board~s Rules and Regulations. Upon Motion
    of Parties the
    Board
    struck the original complaint and allowed leave to
    the Agency to file
    an
    Amended Complaint.
    The Agency now contends that other actions
    involving
    Respondent
    (PcB
    73-396,
    PCB 73-530) have resolved the oroblems raised
    in
    the
    instant complaint, and the Agency does not contemplate filing an
    Amended Complaint. It would seem
    that by agreement of the parties,
    the case should be terminated.
    The Board agrees and will so order.
    ORDER
    IT IS
    THE ORDER of the Illinois Pollution Control Board that the
    complaint entitled PCB 73-409 be dismissed without prejudice.
