DISSENTING OPINION (by J. Theodore Meyer):
I believe that concern for national security takes precedence over the fact that other
compliance options are available to Ensign-Bickford in its request to keep its topographical
map confidential. Therefore, I would have granted the petition for adjusted standard and allow
Ensign-Bickford to provide the Illinois Environmental Protection Agency (Agency) with a
modified topographical map, as well as providing the Agency with access to the protected map
whenever the Agency needed it.
For these reasons, I respectfully dissent.
