ORDER OF THE BOARD
(by Mr. Henss):
Respondent, Environmental Protection Agency, filed its
Recommendation and a Motion for Hearing on February 10, 1975.
The ~Tariance Petition was filed December 31, 1974 and a
decision is due at the Board meeting of March
26,
1975.
The
Motion for Hearing was not timely filed and there is no longer
sufficient time
to give the required notice for a hearing,
allow for the preparation of transcripts of hearings and a
review of those transcripts prior to
a decision by the Board.
For this reason, we feel that we must deny the Motion for
Hearing.
However, we wish to provide an opportunity for the parties
to submit additional information if they so desire.
Therefore,
we will allow ten days from the date of this Order within which
time the parties may file additional statements, exhibits,
comment or argument.
Copies shall be served upon the opposing
party.
The parties are allowed an additional five days for the
filing of rebuttal statements, exhibits, comment or argument.
The last date for the filing of such additional material is
March 14, 1975.
IT IS SO ORDERED.
