ORDER OF THE BOARD (by R.C. Flemal):
On January 16, 1997 the National Steel Corporation Granite City Division (GCD) filed
a petition for an adjusted standard from the Board’s water quality standard relating to
ammonia. On January 23, 1997 the Board found the petition deficient and ordered GCD to
file an amended petition curing the deficiencies within 45 days, or the petition would be
subject to dismissal. On March 6, 1997, at the request of GCD, the Board stayed its order
until May 5, 1997.
Currently before the Board is an April 23, 1997 GCD motion for continuance of
temporary stay. According to GCD, it is carrying on discussions with the Illinois
Environmental Protection Agency. If GCD’s waters are designated as Effluent Modified
Waters GCD would be subject to less stringent ammonia limitations with which it may be able
to comply. These negotiations may therefore result in the withdrawal of the adjusted standard
petition. Consequently GCD requests an additional 60-day stay of the Board’s January 23,
1997 order. On April 29, 1997 GCD filed a letter with the Board stating that the Agency has
consented to GCD’s request for temporary stay. The Board hereby grants GCD’s requested
stay until July 7, 1997. If GCD does not file an amended petition by July 7, 1997, the petition
for adjusted standard filed on January 16
th
will be subject to dismissal. The Board notes that it
will entertain the request for public hearing when and if GCD files a sufficient amended
petition and publishes the requisite notice.
