ORDER OF THE BOARD (by Mr. Dumelle):
The First National Bank of Springfield, Trustee of
Trust #3010 (hereinafter “Petitioner”), on January 29, 1975
filed a Motion to Reconsider the Opinion and Order of the
Board entered on December 19, 1974 which denied the requested
Variance in the above—captioned case. The Environmental
Protection Agency (hereinafter “Agency”) filed a Response
to the Motion to Reconsider on February 10, 1975.
Rule 334 of the Pollution Control Board’s Procedural
Rules allows for motions subsequent to entry of final orders
to be filed within 35 days after the entry of the final
order and within such further time as the Board may allow.
Petitioner’s Motion to Reconsider was not filed during the
35 day period. Petitioner has, in addition to filing the
Motion to Reconsider, filed an appeal on the Board’s decision.
Having fully considered each of the 7 points raised by
Petitioner in its Motion to Reconsider, together with the
attachments, the Board does not find that Petitioner has
raised questions of sufficient merit which would warrant
reconsideration of the Opinion and Order entered in the
above—captioned case.
The Pollution Control Board hereby denies the Motion
to Reconsider.
IT IS SO ORDERED.
