    R97-18
    SAFE DRINKING WATER ACT UPDATE

    (Identical-in-Substance)
    (July 1 through December 31, 1996)
    )
    (Public Water Supplies Rules)
    Proposed Rule.
    Dismissal Order.
ORDER OF THE BOARD (by G.T. Girard):
Pursuant to Section 17.5 of the Environmental Protection Act (Act), the Board would
normally propose amendments to Illinois regulations that are "identical in substance," as
defined in Section 7.2 of the Act, to drinking water rules adopted by the U.S. Environmental
Protection Agency (USEPA) pursuant to Sections 1412(b), 1414(c), 1417(a), and 1445(a) of
the Safe Drinking Water Act (P.L. 93-523), as amended (SDWA). The Board reserved this
docket to incorporate into Illinois law those USEPA amendments made during the period from
    July 1 through December 31, 1996.
During the specified update period, USEPA did not amend its 40 CFR 141 through 143
SDWA regulations. However, USEPA adopted a direct final rule on September 26, 1996, at
61 Fed. Reg. 50485, to approve the amendments to the Illinois SDWA program adopted by
the Board through December 31, 1995. The Board notes this federal action; however, no
corresponding Board action to amend the Illinois SDWA program is made necessary as a
result. This means that the Board need not amend the Illinois drinking water regulations to
    incorporate this federal approval.
For the foregoing reason, the Board hereby dismisses this proceeding.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, do hereby certify
that the above order was adopted on the 1
    st

day of May, 1997, by a vote of 7-0.
    Dorothy M. Gunn, Clerk
    Illinois Pollution Control Board
