ORDER OF THE BOARD (by Mr. Dumelle):

Motion to Dismiss filed by the Agency on I)ecember 13, 1974

is denied. Petition filed December 4, 1974 is inadequate

in that no hardship is alleged. Furthernore, the proceedings

in PCB 72-371 are not stipulated to be entered into this case.

Petitioner shall file an amended petition within 60 days

of the date of this Order with both the

Board and the Agency

setting forth an adequate petition in accordance with Procedural

Rule 401. Failure to timely file shall make the petition

liab1e to dismissal

for inadequacy. The 90-day decision period

set by statute shall run from the date of filing the additional

information.
