ORDER
OF
THE
BOARD

After careful review of
the evidence presented at hearing, the
Board
finds that two specific rules should be separately considered at
this time:
1)
Rule 2O4(c)(1)(B)(i), which limits SO2 emissions
to
six
pounds
per
million
BTU
of heat input.
2)
Rule
204(e),
which
limits
total
loading
of
sulphur
dioxide as a function
of stack height.
The
Board
feels
that
these
two
rules
can
be analyzed
as to the effect
of
such
emissions
on
the
air
quality
of
the
state,
and
that
the
Environmental
Protection
Agency is
the proper party to undertake
such
investigation
at
this
time.
The Agency is thus ordered to commence such study,
and
within
sixty
(60) days from the date of this Order, report to
the Board as
to its findings,
and make such proposals for regulatory change as
it may deem in
the best interests
of
the people of the state.
The intent of the Board in issuing such interim
Order is
to expedite action, while allowing additional time to study what further
orders or proposals would be appropriate.
