ORDER OF THE BOARD (by Mr. Dumelle):
Petition filed November 18, 1974 is inadequate in that a discrepancy
seems to exist as to the reason for the
permit
denial. On page 1 of
the petition the statement is made that the City of Sandwich transport
system is restricted. On page 3 “an overload” is discussed in connection
with the sewage treatment plant.
Petitioner is requested to clarify whether both of the above reasons
exist for the denial or wtiether only a single reason exists and to
identify and explain that reason if the latter is the case.
Petitioner is also requested to quantify the present effluent
characteristics of the sewage treatment plant and the expected environ-
mental impact on the receiving stream if the variance is granted.
Petitioner shall provide the requested information to the Board
and Agency within 45 days from the date of this order. Failure to
timely file the needed information shall make the petition liable to
dismissal for inadequacy. The 90-day decision period set by statute
shall run from the date of filing the amended petition.
