ORDER OF THE BOARD (by R.C. Flemal):
On April 18, 1997 Sequa Corporation, Precoat Metals Division (Sequa) filed a motion for
consolidation of these two air permit appeals. The permits at issue are for emissions from the
same facility and the appeals share common facts and issues. Sequa indicates that the Illinois
Environmental Protection (Agency) supports consolidation.
Pursuant to 35 Ill. Adm. Code 103.141 the Board may consolidate permit appeals in the
interest of a convenient, expeditious and complete determination of claims. The Board finds that
these interests are present in the instant matter, and accordingly we hereby grant the motion to
consolidate the two permit appeals. The caption in today’s order reflects this action.
Additionally, on April 21, 1997 the Agency filed a motion requesting that the Agency’s
record in PCB 97-181 be due for filing thirty days prior to any hearing. The Agency’s record in
PCB 96-62 was due on March 21, 1996 (see Board order of November 2, 1995). The Board
believes that in light of today’s consolidation order, both records should be due on the same date.
Therefore, the Agency’s record in both PCB 97-181 and PCB 96-62 are now due thirty days prior
to hearing in these consolidated matters.
