    By Interim Order dated October 10, 1974,
    we requested
    that by October 22 Petitioner waive for 30 additional days
    the 90—day requirement specified in Section
    38 of the
    Environmental Protection Act.
    Since the waiver has not been
    filed, we rule that Petition For Variance is dismissed, without
    prejudice, because of inadequacy.
