    ORDER OF THE BOARD
    (by Mr. Dumelle):
    The Masonite Corporation filed a Motion to Terminate
    the Daily Testing and Monthly Progress Report requirement
    imposed by an Order of the Board on January 23,
    1975 in the
    above captioned proceeding which granted Masonite a variance
    from Rule 408(a)
    of the Water Pollution Regulations.
    Masonite’s
    request is moot because the Board adopted an amendment to
    the fluoride effluent standards found in Rule 408(a)
    of the
    Water Pollution Regulations on March
    6,
    1975 which became
    effective upon filing with the Secretary of State,
    The
    Board set a new fluoride effluent limitation of
    15 mg/i in
    place of the existing 2.5 mg/i standard.
    The adoption of
    the regulation amendment setting a higher allowable standard
    than that contained in the variance takes precedent over the
    variance order.
    In addition, Masonite was granted a variance
    “until January 23,
    1976 or until the Board’s pending amendment
    of Rule 408(a)
    is enacted, whichever occurs earlier”.
    Therefore, Masonite’s variance expired on March
    6,
    1975
    the
    date on which the Board enacted the amendment.
