On March 11 and March 12, 1975 the parties filed a
flurry of pleadings relating to discovery and relating
to the issues formed by the pleadings.
The new pleadings
include an attempt to amend the Answer and Counter—Claim,
to quash the Subpoena and Motion to Produce Documents.
The
Hearing Officer has authority to rule on all of these
matters and should make the initial ruling prior to con-
sideration of the record by the Board.
This case has been sche~1u1edfor hearing on
the
merits
March 19, 1975 and we are told that the Hearing Officer is
currently out of the city on a vacation so that his ruling
cannot be obtained sufficiently
In advance of the hearing
to allow the parties
to prepare for trial.
The next meeting
of the Pollution Control Board is March
26,
1975.
Under all
of the circumstances the Board has decided to postpone the
hearing until at least one week after the next Board meeting.
This should allow sufficient time
for
the Hearing Officer to
rule on the pre—trial motions and any party to request Board
review of a ruling.
It is Ordered that the hearing currently scheduled for
March 19,
1975 be cancelled and that hearing be rescheduled
by the Hearing Officer not sooner than one week after March 26,
1975.
