INTERIM ORDER OF THE BOARD (by Mr. Goodman):
This matter
comes
before the Pollution Control Board
(Board) upon the Village of Potomac~s (Potomac) June 11,
1975, petition for a variance from the Rules and Regulations
governing Water Pollution.
The Board finds the variance petition as submitted to
be insufficient. The petition fails to specify the rules
from which a variance is sought. In addition, the petition
does not contain an adequate compliance plan, nor were the
exhibits, referred to in the petition, attached to the
petition.
In consideration of the foregoing it is the order of
the Board that Potomac file an amended petition within
forty-five days of this order. Said amended petition shall
contain a statement of the specific rules from which a
variance is sought; the exhibits referred to in the peti-
tion; and a compliance plan. The ninety-day decision rule
shall run from the date of filing of said amended petition.
Failure of Potomac to file an amended petition within the
time limits set forth herein, shall cause this variance
action to be dismissed without prejudice.
