ORDER OF THE BOARD
(by Mr. Goodman):
This matter comes before
the
Board upon the Petition filed by
Illinois Power Company
(IPC)
on January
5, 1977,
to adopt a pro-
posed Rule 204.1 of the Air Pollution Control Regulations.
IPC’s
proposal results from its uncertainty as to the status of the regu—
lations governing SO2 emissions from the company’s Baldwin generating
station.
As IPC points out in paragraph
(4)
of its Petition, the
Board currently has pending before it a number of proposals,
including
R76—9,
R74-2, R75-5,
and R71—23, which involve
the review and possible
revision of the sulfur dioxide emissions limitations.
In addition, a
petition for variance from Rule 204(e)
for IPC’s Baldwin Station is
currently before the Board.
The Board finds that yet another regula-
tory proposal would not solve the problem but would merely accentuate
the existing uncertainty.
The Board, therefore,
denies IPC’s Petition
of January
5,
1977,
as duplicitous of matters already before the
Board.
