    ORDER OF THE BOARD (by T. E. Johnson):
     
    On January 27, 2003, the parties filed a joint request to extend the 35-day period within
    which Clark Oil Station #1655 (Clark Oil) may appeal a December 19, 2002 determination of the
    Illinois Environmental Protection Agency (Agency).

    Adm. Code 105.206(c), 105.208(a), (c). The joint request was placed in the U.S. mail on
    January 24, 2003. Because the post-mark date precedes the 35-day filing deadline, the joint
    request was filed in a timely manner. 35 Ill. Adm. Code 101.300. The Agency applied a
    $10,000 deductible to a reimbursement claim regarding Clark Oil’s underground storage tank
    site at 1130 North State Street in Vermilion County. The Board extends the appeal period until
    April 24, 2003.

    fails to file an appeal on or before that date, the Board will dismiss this case and close the docket.
