ORDER OF
THE
BOARD
(by Dr.
Odell)
On September 25,
1973, Mobil Joliet Refining Corporation
filed with the Illinois Pollution Control Board
(Board)
a
Petition for Variance for a period of one year from Rule 203(d)
of Chapter
2, Air Pollution Regulations and/or Rule 3-3.111 of
the Rules and Regulations Governing the Control of Air Pollution.
The Board requested more information on September 26, 1973, and
an Addendum to Petition for Variance was received by the Board
on October
30,
1973.
A Petition For Intervention was filed by Mobil Oil
Corporation on October 30, 1973.
The Petition is denied.
Board
action in this case makes clear that Mobile Oil is not prejudic-
ed by this decision.
Petitioner owns a petroleum refinery for processing crude
oil into gasoline in Channahon Township, Will County, Illinois.
Petitioner’s facilities include a fluid catalytic cracking unit
(FCCV) which is the subject of this Petition for Variance.
The Illinois Environmental Protection Agency
(Agency) filed
a Recommendation with the Board on December
5,
1973.
Copies of
letters from Petitioner
to the Agency, which were received by the
Board on December 21, 1973 and July 12, 1974, suggested that this
facility may be in compliance and a variance may not be needed.
On May 14, 1975,
the Board received a Petition from Mobil
Joliet Refining Corporation which “requests that its Petition for
Variance
.
.
.
be withdrawn.”
The Board hereby grants Petitioner’s motion to withdraw and
dismisses without prejudice this Petition for Variance.
IT IS
SO ORDERED.
I, Christan L. Moffett, Clerk of the Illinois Pollution Control
Board, here~ycertify that the above Opinion and Order was adopted
