FORD MOTOR COMPANY,
Respondent.
ORDER OF THE BOARD (by Mr. Henss):
Ford Motor Company has filed Motion to Dismiss PCB 75-142
on the ground that it is inappropriate to go forward with that
enforcement proceeding while Ford is appealing from the Agency’s
denial of its applications for operating permit. The parties
have also filed various Motions for Consolidation. The permit
appeals and enforcement action do involve the same parties and
the same issues. In this instance, it seems appropriate to the
Board that the three actions be consolidated for hearing and
that the Motion to Dismiss be decided at the conclusion of the
proceedings.

Therefore, it is ordered that the three actions
PCB 75-149, PCB 75-169, and PCB 75-142 be consolidated for
hearing. Respondent’s Motion to Dismiss in PCB 75-142 is
taken with the case.
