CHRYSLER CORPORATION,
)
Petitioner,
v.
)
PCB 75—103
ENVIRONMENTAL PROTECTION AGENCY,
Respondent.
OPINION AND ORDER OF THE BOARD
(by Mr. Goodman):
This matter comes before the Pollution Control ~oar~
(Board)
on Chrysler Corporation’s
(Chrysler)
petition for a
variance from Rule 205(f)
of Chapter
2 of the Illinois
Pollution Control Board Rules and Regulations.
The petition
was filed February 28,
1975.
The petition was held made—
quate on March
6,
1975.
Chrysler amended its petition on
March
24,
1975.
Chrysler’s petition is still inadequate.
Chrysler has
failed to include an adequate compliance schedule.
The
petition also fails to meet certain requirements
as enun-
ciated in Train
v.
NRDC,
43 USLW 4467
(US No. 73—1742 April
15, 1975)~ in that the petition fails to show~
U
whether
the ambient air quality in the effected area meets the
primary and/or secondary ambient air quality standards as
adopted by the Board; and
2)
if the area does meet those
standards, whether Petitioner’s emissions would cause the
affected area to fail to meet those standards; and
3)
if the
effected area does not meet the ambient air quality stand-
ards, whether Petitioner’s emissions contribute to such
failure.
Therefore,
it is the order of the Board that Chrysler’s
variance be and is hereby denied without prejudice.
IT IS SO
ORDERED.
I, Christan L. Moffett, Clerk of the Illinois Pollution
Control Board,
do hereby certify that the above Opinion and
Order were adopted ~n the
