This matter comes before the Pollution Control Board

(Board) upon Petitioner’s motion to withdraw its “Petition for

Hearing and Review of Denial of Construction Permit”. It

is the Order of the Board that the Petition be withdrawn

and the cause be and hereby is dismissed without prejudice.
