(Adjusted Standard - Air)
ORDER OF THE BOARD (by J. Theodore Meyer):
This matter comes before the Board on a status report and request for extension of stay
filed March 17, 1997 by Abbott Laboratories (Abbott). The present matter is subject to a stay
pending approval of the United States Environmental Protection Agency (USEPA) of the
Board’s rulemaking R94-31, an amendment to 35 Ill. Adm. Code 218 Subpart T, Section
218.480(i). Abbott states that on March 12, 1997 the USEPA published a “direct final rule”
effective May 12, 1997, approving certain amendments to the Illinois State Implementation
Plan, including the amendment to Section 218.480(i). (62 Fed. Reg. 11327 (March 12,
1997).) Abbott further states that the rule as approved is subject to further review by USEPA
if comments not previously addressed are received by USEPA on or before April 11, 1997.
Abbott therefore requests an extension of the stay in this matter until May 12, 1997, the
effective date of the USEPA’s direct final rule.
The motion for stay is granted until May 12, 1997. The parties are directed to file
status reports, either jointly or separately, no later than May 12, 1997, advising the Board of
any comments received by USEPA on or before April 11, 1997, and of plans to resolve this
matter once the action by USEPA becomes final and effective.
IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that
the above order was adopted on the _____ day of ___________, 1997, by a vote of
______________.
