ORDER OF THE BOARD (by Mr. Henss):
On July 24, 1975 the Board determined that the Petition
for Variance is i~iadequateand granted Petitioner 35 days to
file an Amended Petition and provide the information required.
The Order of the Board specifically stated:
“Failure to timely file the Amended Petition
shall render the cause liable to dismissal
for inadequacj.”
The Amended Petition has not been filed. We find that
the Petition is inadequate for the reasons previously expressed
in our July 24, 1975 Order. Therefore, the Petition will be
dismissed without prejudice.
It is Ordered that the Petition for Variance be dismissed
without prejudice.
