The Pollution Control Board finds that it lacks jurisdiction

to consider the allegation of a violation of Section 12(f) of the

Illinois Environmental Protection Act for failure to apply for

and possess a National Pollutant Discharge Elimination System

(NPDES) permit (See EPA v. Freeman Coal Mining Company, et al,

PCB 75—22 (August 28, 1975)).
