MASON AND MEENTS CONSTRUCTION
COMPANY,

ENVIRONMENTAL PROTECTION AGENCY,
Respondent.
INTERIM ORDER OF THE BOARD (by Mr. Goodman):
It is the opinion of the Pollution Control Board (Board)
that Mason and Meents Construction Company’s (Mason and
Meents) compliance plan lacks the certainty required by
Procedural Rule 401(viii). Before a compliance plan can be
approved, Mason and Meents must select the method it intends
to use to achieve compliance. This is especially important
as one of the proposed compliance plans is to modify an
existing wet scrubber. The Board feels that the plans for
said modification, as set forth in Addendum A, would not
result in compliance.
A waiver of °rocedural Rule 408 having been filed, this
matter is herewitn continued until September 18, 1975, at
which time Mason and Meents is ordered to file with the
Board an amended variance petition which specifies the
compliance plan it will pursue.
IT IS SO ORDERED.
