ORDER OF THE BOARD (by Mr. Henss):
Petitioner reque5ts variance from the Air Pollution Control
P~cgulations dealing with compliance programs and project
completion schedules (Rule 104), the particulate emission
standards for incinerators Rule 203(e) and the carbon monoxide
emission standards for incinerators Rule 206(b). The purpose
of the variance is to allow Petitioner to burn explosive wastes
in its incinerator. Under the recent United States Supreme
Court decision, Train, Administrator etc. vs. Natural Resources
Defense Council (No. 73-1742), it will be necessary to establish
that the grant of the variance will not interfere with the
attainment and subsequent maintenance of national ambient air
quality standards. The petition seems to be specific in alleging
that the air quality standards for particulates will be met but
is inadequate in its allegations regarding the national ambient
air ‘~uzJity standard for carbon monoxide. The Board orders
r’etitioner to file within 45 days such additional information as

national ambient air quality standards for carbon monoxide. Since
public hearings have been held on similar variance requests by
Petitioner the Board does not deem it necessary to schedule a
public hearing on this petition. Failure to file the missing
information, however, may result in a determination that the
petition is inadequate.
It is Ordered that Petitioner within 45 days of this Order
file additional information from which it can be determined whether
