ORDER OF THE BOARD (by Mr. Dumelle):

The variance petition is inadequate in that the following

information is not provided: the scientific formulation of the

herbicide, the environmental effects of the herbicide, the

concentrations to be used, the name and location of the lake

to be treated, and whether the lake is a source of public or

private drinking water. Petitioner shall amend its variance

petition within 45 days to provide this information. The

90-day decision period shall run from the date of filing the

amended petition. Failure to comply with this Order shall

result in Petitioner’s variance request being dismissed for

inadequacy.
