denied.
Paragraph
13 of Count II
is stricken because
it alleges a violation
of Section 12(f)
of the Environmental Protection Act for
discharging contaminants without a National Pollutant Discharge
Elimination System
(NPDES)
permit issued by the Illinois Environmental
Protection Agency.
We
find that the Board does not have jurisdiction
to consider such an allegation prior to the date the Administrator
of the U.S. Environmental Protection Agency approves pursuant to
the Federal Water Pollution Control Act, the Illinois request to
administer the
NPDES
permit system.
Until Illinois has the authority

to administer the NPDES permit system,
the Board
is without jurisdiction
to compel a discharger
to obtain an NPDES permit.
