INTERIM ORDER OF THE BOARD (by Mr. Zeitlin):
Respondent f.led with the Board on July 25, 1975, a
Motion For Stay Of Proceedings, and on July 28, 1975 a
Motion For Oral Argument.
Respondent asserts that the basis for its Motion For
Stay is a pending appeal to the Illinois Supreme Court of
Commonwealth Edison Company v. Illinois Pollution Control Board,
Docket No. 47352 (1975), concerning Rule 203(g) of the
Board’s Air Pollutior. Regulations. The issue before the
Board concerns, in part, the application of Rule 203(g).
The Board is of the opinion that pursuant to Supreme Court
Rule 368(b), the ‘~alidityof Rule 203(g) is automatically
stayed, rendering Rule 203(g) fully effective during the
pendency of the issue before the Supreme Court. Respondent’s
Notion For Stay Of Proceedings is hereby denied.
Respondent’s Motion For Oral Argument before the Board
at its August 7, 1975 meeting is herewith denied.
