ORDER OF THE BOARD

This matter comes before the Board upon Motion for
Modification of Order by the Respondent-Petitioner,
the
Illinois Nitrogen Corporation.
The Board
finds that the
Opinion and Order of the Board of the above-captioned case
dated June
26,
1975,
correctly reflects the stipulation and
proposed settlemmt
as
filed by the parties
in the case.
However,
the Board agrees that the new paragraph proposed by
Respondent-Petitioner,
in lieu of the existing paragraph One
of the Board’s Order, more
fully sets forth the facts
as
found by the Board in its Opinion.
Paragraph One of the Board’s Order of June 26,
1975,
is
hereby amended to read as follows:
Illinois Nitrogen Corporation
is found to
have operated its amrnonium nitrate prilling tower
in violation of Rule 203 of the Illinois Air
Pollution R?’gulations and that part of Section
9(a)
of the
Z~.ctwhich prohibits violations of
Regulations or standards adopted by the Board.
Illinois Nitrogen
is further found to have op-
erated its arnmonium nitrate prilling tower without
a permit in vi~lationof Rule 103(b)
of the Illi-
nois Air Pollution Regulations and is ordered to
pay a penalty of $2500.00 for said
violation,
payment
to be made by certified check or money
order, payable to the State of Illinois,
Envi—
ronmental Protection Agency, Fiscal Services
Division,
2200 Churchill Road,
Springfield,
Illinois
62706, paymEnt to be made within 35 days of the
adoption of this Order.
